American Power Services' Heat Transfer Equipment & Services Warranty

American Power Services warrants that the materials and equipment it furnishes or provides shall be free from defects arising from normal usage for a period of two (2) years from start up of said equipment or for a period of two (2) years from the date of installation if the equipment was also installed by APS.  Additionally, American Power Services warrants that all service labor performed by APS shall be free from workmanship related defects for a period of one (1) year.  This warranty is expressly limited to the Purchaser's equipment that had specific service work performed on it by American Power Services. These warranties do not extend to any equipment, materials or services that were provided by others, or equipment or materials that were abused, altered, misused, or were not being properly or periodically maintained. THESE WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY AND FITNESS FOR A SPECIFIC PURPOSE. American Power Services shall not be liable for any special, indirect or consequential damages arising in any manner out of the performance of this agreement.
