American Power Services warrants that the materials and equipment furnished by it shall be free of defects in tube material under manufacturer warranty and workmanship arising from normal usage for a period of two (2) years from start up of said equipment or if installed by American Power Services, for a period of two (2) years from the date of installation. American Power Services additionally warrants all service labor performed to be free from defects in workmanship for a period of one (1) year. American Power Services expressly limits its warranty on Purchaser's equipment which had specific service work done by American Power Services. These warranties do not extend to any equipment or service which has been repaired by others, abused, altered, or misused, or which has not been properly or occasionally maintained. THESE WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THOSE OF MERCHANTABILITY AND FITNESS FOR A SPECIFIC PURPOSE. American Power Services shall not be liable for any special, indirect or consequential damages arising in any manner out of the performance of this agreement.
